Gun carry permit for realtors, business owners and CACs: bills versus current law
A carry permit for realtors, business owners or CACs in Brazil is not law yet. See the stage of bills 942/2026, 1038/2025 and 5438/2025 on Oct. 19, 2026.

As of October 19, 2026, no Brazilian law grants a gun carry permit to realtors, business owners, MEIs (individual microentrepreneurs) or sport shooters based only on their profession or registration. There are bills in the Chamber of Deputies (Câmara dos Deputados) on these groups, but all of them are still in committees. Today, anyone who wants a carry permit must apply to the Federal Police (Polícia Federal, PF) and prove effective need, like any other citizen.
Note: websites that say the carry permit "was approved" usually refer to approval in a single committee. That does not change the law. This text is for information only and does not replace legal advice or guidance from the Federal Police.
What applies to carry permits today?
The rule comes from the Disarmament Statute (Law 10.826/2003, Lei 10.826/2003). Article 6 bans carrying firearms throughout the country, except for categories listed in the law itself, such as the Armed Forces and public security agencies.
For ordinary citizens, the path is Article 10: the PF may grant a carry permit to anyone who demonstrates "effective need due to a risky professional activity or a threat to their physical integrity". Each application is assessed case by case.
Realtors, business owners and MEIs are not on the Article 6 list. They can apply for a carry permit under Article 10, but the profession alone does not guarantee the authorization. See the step by step in how to get a carry permit in 2026.
CACs (collectors, sport shooters and hunters) have the transit carry, which only allows them to move the unloaded firearm with the transit permit (guia de tráfego), on the route and within the period of the permit. See how to issue the transit permit in Sinarm CAC.
What stage are the bills at?
The table summarizes the situation in the Chamber, checked in the Chamber's Open Data (Dados Abertos) on October 19, 2026:
Bill | Who it covers | Last completed stage | Where it is now |
|---|---|---|---|
Realtors (ownership and carry) | Report approved by the Public Security Committee on June 16, 2026 | Constitution and Justice Committee (CCJC), awaiting a rapporteur since June 19, 2026 | |
Sport shooters | Report approved by the Public Security Committee on March 24, 2026 | Finance and Taxation Committee (CFT), awaiting a rapporteur since March 30, 2026 | |
Business owners and owners of commercial establishments | Report approved by the Public Security Committee on August 11, 2026 | CCJC, received on August 13, 2026 | |
Business owners and entrepreneurs | Attached to PL 5438/2025 on March 31, 2026 | Moves together with PL 5438/2025 |
None of them has gone through the CCJC, the Chamber floor or the Senate.
What does the realtors' bill propose?
According to its summary, PL 942/2026 "provides for granting firearm ownership and carry to realtors in the exercise of their professional activities".
It was introduced on March 4, 2026. The Public Security and Organized Crime Committee (CSPCCO) approved a report with a substitute text on June 16, 2026. Since June 19, 2026, the bill has been at the CCJC, still without a rapporteur.
What does the sport shooters' bill propose?
The original text of PL 1038/2025 granted a carry permit to level 3 shooters with more than 3 years of Registration Certificate (CR). The version approved by the CSPCCO on March 24, 2026 changed that.
According to a March 27, 2026 report by Agência Câmara, the approved text authorizes a self-defense carry permit for shooters who have held a CR for more than one year, starting at level 1. To get the permit, they would have to prove technical proficiency and pass a psychological assessment, without paying fees.
The bill still has to go through the CFT and the CCJC.
Is there a carry permit for MEIs?
There is no law. In the Chamber's Open Data, the closest bill is PL 1020/2026, which covers "business owners and entrepreneurs". Its summary does not mention MEIs.
That bill was attached to PL 5438/2025, on "business owners and owners of commercial establishments". PL 5438 had a report approved by the CSPCCO on August 11, 2026 and went to the CCJC on August 13, 2026.
What is still missing for any of these bills to become law?
All four bills are subject to conclusive review by the committees, according to the Chamber. This means they can be approved in the Chamber without going to the floor, if they pass all committees and no appeal is filed.
After that, three steps remain:
- approval by the Senate;
- presidential sanction, which may include vetoes;
- publication in the Official Gazette (Diário Oficial da União).
Until then, the rule remains Article 10 of Law 10.826. To find out whether a bill has become law, follow its page on the Chamber website and the Official Gazette.
Next step
If you need a carry permit now, the path is an application to the PF with well documented effective need. We will update this text if any of these bills moves forward.
